This page sets out the terms and conditions of the Restaurants.mu website and the services we offer. By accessing, browsing and using Restaurants.mu and/or by making a purchase through us, you are acknowledging and agreeing to having read, understood and agreed to the following Terms & Conditions.

Our aim is to be as professional, efficient and courteous as possible with our users, customers and business partners. As such it is important to know the terms and conditions and who we are. This is a legal document which is the agreement between Restaurants.mu (whom we refer to as "we", "our" and "us") and the User (referred to as "you", "your", "he", "she", "the User" or "the Customer" in this document) who is the person using the site and/or making the reservation, including also all bookings made for one, two or more people; these terms are applicable for all the people in your group, referring to any person who will accompany you or is to attend the booking; for the avoidance of doubt any individual you make a booking on behalf of.

It is taken that you are the lead contact for your group and that therefore all correspondence and conversations in respect of arrangements for yourself and all members of your group will take place between you and us. Thus you are agreeing to the Terms and Conditions that appear below, all of which are called the "Agreement". We reserve the right to amend these terms and conditions at any time. No alteration to these conditions shall be effective unless expressly agreed to in writing by the director of Restaurants.mu.

Original Language and Translations We may translate these Terms into other languages for your convenience. Nevertheless, the English version governs your relationship with Restaurants.mu, and any inconsistencies among the different versions will be resolved in favor of the English version.

Description of Services Restaurants.mu is the operator of this website, offering a range of services, discounted meal packages, reviews, a restaurant directory, content and products along others.

The Restaurants.mu website allows users to access a comprehensive restaurant directory and guide, where they can use an advanced search engine which filters search results by various parameters such as restaurant name, location, price, etc. Users may also access specific restaurant information, such as opening hours, cuisine type and contact details whilst also being able submit a restaurant review or read other user-submitted reviews and purchase discounted meal packages at selected restaurants/ business partners.

For the restaurant business sector, it enables restaurant owners in Mauritius to have their own listing on the Restaurants.mu website and to promote their restaurants and food related business. Restaurants.mu offers a range of advertising packages and marketing solutions to restaurants owners, which can be read up on the website.

Eligibility Eligible service providers on the Restaurants.mu website are restaurants, bars, clubs, cafes, culinary catering institutions, food related shops and any other food related businesses referring to individuals, institutions, organizations and companies directly or indirectly involved in the food, drinks and clubbing industries. In order to be listed in the Restaurants.mu directory and database, all service providers must be in possession of all relevant permits and licenses as requested by law and by the different authorities wherever applicable. Service providers that do not respect domestic laws and regulations, basic moral values and the environment cannot qualify. The liability to obtain all licenses and permits is strictly limited to the service providers and Restaurants.mu is not to be found in fault or is to have any liability in case any of the business listed on the Restaurants.mu did not obtain the permits and licenses as required by the laws of the Republic of Mauritius.

Identity Verification and Registration You may access many areas of the website and its functionality without registering your details with us. Though in order to post a review, respond to a review, make a purchase on this website, post an event or perform various other actions on the website, you may be requested to provide us with your details or register and create an account with Restaurants.mu. It is to be noted that the each user acknowledge that by registration or providing any personal details via the Restaurants.mu website, the user also warrants that they are of at least 18 years of age.

Business & restaurant owners will need to register an account with us in order to have access to certain areas of the site which would enable them to edit and post content on the website related to their restaurant or business.

Use of any personal information you provide to us during the account creation or verification process is governed by our Privacy Policy.

In order to post or respond to a review, your name and email address are required. Additional information pertaining to your visit of the restaurant such as the date, time and the restaurant bill may also be required for validation purposes.

In order to make a booking, you must register. To Register, you need to provide us with your name, email address, password and possibly some other personal information. You must make sure that your password is kept confidential and should inform us immediately if you have any reason to believe that your password has become known to any unauthorized third party or if there is any unauthorized use of your email address and account. You agree that we are not responsible for any operations and use that occur under your account; you are solely responsible if you do not maintain the confidentiality of your password.

All Accounts must be registered with a valid personal email address that you access regularly. Any Accounts which have been registered with someone else?s email address or with a temporary email address may be closed without notice. We may require users to re-validate their Accounts if we believe they have been using an invalid email address.

User Content and Conduct You understand that you are responsible for any Content that you post or transmit on or through the Site. You agree not to cause, nor knowingly allow others to cause, any nuisance, annoyance, or inconvenience, whether to Restaurants.mu, or any of its customers or users of the Site by any means.

You acknowledge that you (and not Restaurants.mu) are solely responsible for whatever material (including but not limited to reviews, photos, comments and/or any other data) you submit on this website, and you have full responsibility for the message, including its legality, reliability, appropriateness, originality and copyright.

You are prohibited from posting or transmitting to or from our Website any material:

  • that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; or
  • for which you have not obtained all necessary licenses and/or approvals; or
  • which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in the Mauritius, or any other country in the world; or
  • which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data). You may not misuse our Website (including, without limitation, by hacking).

If we, in our absolute discretion, consider that you have made improper use of the Website or any part thereof, we reserve the right to remove without notice any unacceptable or undesirable content or material and to block, suspend or terminate without notice your access to our Website or any part thereof.

Limitation of Liability & Disclaimer of Warranties Any Content downloaded, uploaded or otherwise obtained through the use of the Site is done at your own discretion and risk. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the Site or on the Internet generally.

Restaurants.mu does not warrant or make any representations regarding the use of or the result of the use of the material in this web site or as to the correctness, accuracy, reliability, proprietary character or otherwise of the site content.

Any User Content of any kind made by you or any third-party is made by the respective author(s) or distributor(s) and not by Restaurants.mu. Other users may post User Content that is inaccurate, misleading or deceptive. Restaurants.mu does not endorse and is not responsible for any User Content, and will not be liable to you or any other person for any loss or damage caused by your reliance on such User Content. User Content reflects the opinions of the person submitting it and does not reflect the opinion of Restaurants.mu. Restaurants.mu does not control or endorse any User Content, and specifically disclaims any liability concerning or relating to your contribution of, use of, or reliance on any User Content and any actions resulting from your participation in any part of the Site or Services, including any objectionable User Content. Limited Right to Use The viewing, printing or downloading of any content, including but not limited to data, information, text, graphics or images from the Restuarants.mu website grants you only a limited, non-exclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sub-license, sale, preparation of derivative works or other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution).

Copyright The Site contains copyrighted material, trademarks and other proprietary information, including, but not limited to text, software, graphics, designs, compilation, video, music and sound. The entire contents of the Site are protected under applicable copyrights, trademarks, registered trademarks and other proprietary (including but not limited to intellectual property) rights.

The copying, redistribution, use or publication of any such matters or any part of the Site by you for commercial gain is strictly prohibited unless authorized in written by the owner of the site. You do not acquire ownership rights to any content, document or other materials viewed through the Site. You will be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights or any other harm resulting from such a submission.

Nothing on this site should be copied or used for commercial gain without the written consent of the owner.


Terms and Conditions of Sale

The following sales terms are communicated to each customer every time they processes an order. Processing an order implies that the customer adheres to the Terms and Conditions of Sale.

Reservations We advise you to place your order a minimum 5 days before your preferred date so that we can process with your request for reservation fully and provide you with the package on your proposed date. All reservations are subjected to availability.

Any disability, limitation, food allergy, or any other request which requires special attention should be reported at the time of booking. We will make all our best to cater for the needs of the disabled participant. By making a booking with us (whether directly through Restaurants.mu's website or by email), you and all members of your group have well understood and accepted our Terms & Conditions and that in the case of group bookings (2 persons & more), the person making the reservation is responsible for making all members of his or her group aware of these conditions.

Products and packages The products and packages offered have defined validity periods and are offered under the limitation of availability and they are supplied to the customer through our service providers and third parties. The photos, illustrations and other promotional material used for the description of the product/package are for the purpose of exemplifying products of the same type of package. We cannot guarantee that all photos advertised and used on our website illustrate the exact meals, offering, restaurants and packages as offered by the service provider. The only purpose of these photos is to give the customers a better idea of the product/package. The descriptions and illustrations on any of our content and our website are given as approximate representations only, but in good faith. It is important to note that the scheduled times for the products/packages may change without notice. Restaurants.mu aims to be accurate on the details shown on its website and in its offers but we make no commitment about the accuracy, reliability, or timeliness of the Material or about the results you will obtain from using our Website and Material.

Provision of Service No compensation of any kind or responsibility can be taken due to circumstances beyond our or our supplier?s control. For example, when we have to notify a change to your arrangements after you attend the meal, or we or our service provider cannot offer your arrangements in full or in part as agreed, or you suffer any loss, injury, food allergy, good poisoning, or damage of any description to person or personal property. A circumstance beyond our or our supplier?s control is unpredictable or avoided, even after taking all due care, includes but is not limited to war, terrorist activity, civil unrest, industrial disputes, acts of god, natural or nuclear disaster, high level of water, technical or maintenance problems and bad weather situations or forecasts. Restaurants.mu also reserves the right to cancel scheduled packages at any time in the event of hazardous weather conditions or unforeseen operational problems. We reserves the right to refuse admission to anyone at its sole discretion.

Prices Please refer to the product description for the price of each specific Product or Package. All prices are listed in Mauritian rupees and are inclusive of VAT at the applicable rate at the time of your order. Packages once sold are not exchangeable and non-refundable. All products/packages are final, and no changes to the Conditions, Highlights or description are allowed. These will be clearly specified at the time of booking and on the confirmation email. Prices are based on the local tariffs offered by our service providers.

Unless detailed otherwise in the specification of the activity, these prices do not include supplements, transportation, drinks, meal upgrades, and do not include any other service which is not detailed in the specification of the package. As we act only as an agent for our service providers, we and our service providers reserve the right to change, amend or correct prices shown on our site at any time before or after you have booked. The meal packages and services are subject to currency fluctuation. After you have booked, if the price of your booking changes in such a way, we will pass on the details of the change as soon as possible.

The user will be required to read carefully and accept the terms and conditions which are displayed on our website before making a booking. Once the booking has been made, the user and the service provider of the product will be bound by such terms and conditions and both parties will receive a booking confirmation email.

We do not guarantee against pricing errors or issues with regards to programming and reserve the right, at its sole discretion, to not process or to cancel any orders placed for a product or service whose price was incorrectly posted or issues with programming that results in an error. If this occurs, Restaurants.mu will notify you by email and or by phone and a full refund will be given. In addition, we reserve the right, at its sole discretion, to correct any errors in availability.

Charge-back customers who pull chargebacks will be reported to all major credit bureaus as a delinquent collection account.

Payment System & Payment Methods Restaurants.mu uses the MIGS MasterCard secure online payment system operated by the Mauritius Commercial Bank (MCB). Online Reservations can only be made with a valid credit card. If you do not want to use our payment system or do not own a credit card, you can always contact us directly to discuss alternative payment methods. MasterCard guarantees a high level protection when providing your credit card number. Information regarding the latter is not accessible to third parties and is not communicated to us and is only kept on the secure database of MasterCard. The order confirmed by the client will be considered valid only when approved by "MasterCard". After placing your order, your credit card shall automatically be debited with the full amount due upon logging out of your account. Once the payment is cleared, you will receive an automated confirmation email of your order. If MasterCard does not approve the transaction, the order will be automatically canceled and the client will be informed by email.

For web orders, full payment by credit card is required to make a reservation and only credit cards are accepted. Credit cards which are accepted:

  • VISA
  • MasterCard

It is also possible to pay by bank transfer directly to Restaurants.mu's bank account or MCB Juice or have the payment done directly in cash or debit card at the registered office of Restaurants.mu.

Under no circumstances will Restaurants.mu be liable for any kind of commission that your bank might charge you for payment paid to Restaurants.mu.

Booking Confirmation Once you have made the payment, a Booking confirmation e-mail will be sent immediately after you "Place Order" for which it is important for us to have an accurate email address. If you do not receive a confirmation e-mail within the next 15 Minutes of placing the Order, you should contact our Customer Services department at [email protected].

Our Booking Confirmation e-mail is a proof of a valid booking and will contain relevant information about the booking and particulars of the restaurant or services concerned. Please read and check carefully all the information contained in your Booking Confirmation e-mail to ensure that it conforms to your reservation made. If there are any changes to the details, we request that you inform us immediately by email, phone or by contacting our Customer Service department.

You will be required to print and produce your Booking Confirmation when you check-in at the restaurant or at the establishment.

Open Voucher Validation We offer our customer the option to order an open voucher for a specific Restaurant Package or other related services. The open voucher can only be used for the specific product for which it has been booked as detailed on the order confirmation and on the voucher itself.

Please note that the Open Voucher is only valid for use for the relevant product or service for which it was purchased and is valid for a period of 3 months from the day of its purchase; meaning, that the product or package purchased must be used within a maximum period of 3 months from the date of purchase.

In case the customer fails in using the open voucher during the period of 3 month, and fails to dine or claim their product/package or for any other services for which it has been purchased, the open voucher will no longer be of any use or value and it will be void. In case of a void open voucher, the customer will not be entitled to receive any refund nor compensation against the payment made to purchase the voucher. This is why we strongly encourage our customers not to wait for the last moment in order to use the open voucher.

Using an Open Voucher for reserving a product In order for us to process your reservation request in full and provide you with the service/product on your preferred date, we strongly advise that you will place your request for reserving the service or product a minimum of 5 days before the date on which you would like to go/use the product or service offered.

Please note that all reservations are subjected to availability. In case you request to reserve a product or service for a specific date less than 5 days prior to the date on which you would like to go/use it, we cannot guarantee that your reservation will be confirmed or will be done successfully. Accordingly, for late reservations requests made during the period of the last 5 days of the open voucher validation period (referring to the last 5 days out of the 3 months period), we cannot guarantee that these reservations will be confirmed or done successfully. In case Restaurants.mu will not be able to confirm such a late reservations requests, and due to this open voucher not being used during the period of 3 months of its validation, the customer will not be entitled to any refund nor compensation against the payment made to purchase this voucher. This is because it is in the customer responsibility to reserve the product or service on an earlier stage, while providing Restuarants.mu at least 5 days in order to confirm the booking. We thus strongly encourage our customers not to wait for the last moment in order to use the open voucher.

Complaints and problems In the unlikely event that you have any reason to complain or in case you experience any problems with your product or service, this must be brought to the attention of the relevant supplier immediately so that action can be taken to remedy the problem.

Unfortunately some problems cannot be dealt with quickly. If you are still dissatisfied, you must write to us within 14 days of the meal/event/experience, mentioning your booking reference and full details of your complaint. The assistance we provide to resolve your complaint is provided on behalf of our service providers in our capacity as agents only. We will do our best in order to claim a full refund or compensation from our supplier on your behalf.

Please note that if you fail to follow this simple complaints procedure, Restaurants.mu will not be able to claim the refund or compensation on your behalf, and accordingly you will not be entitled or will lose the refund or compensation which you could have redeemed.

Damage to or theft of personal belongings Restaurants.mu cannot be held liable if a client's personal belongings are damaged or stolen during his or her visit to the restaurant or at the designated location. It follows, therefore, that Restaurants.mu is not obliged to compensate its clients for damages in this regard. Each client has a personal responsibility to take due care and attention by keeping close watch on his or her personal belongings and to refrain from bringing valuables.

We shall accept no responsibility for the loss of, or damage to, personal property or valuables. Insurance to cover the loss of baggage and valuables is also highly recommended and is not in any means included in any of our products or any other services.

Refund of processing fees In case of any cancellation due to any reason of any booking made with Restaurants.mu; Restaurants.mu is not liable to refund the credit card processing fees nor any other bank fees associated to the purchase made by the customer. The customer will only receive the applicable refund calculated as per the Restaurants.mu refund policy, after deducting the fees detailed hereof.

Refunds applicable for Non-eligible customers Some of the discounted deals, offers and packages offered on Restaurants.mu do have limiting conditions on the number of participants, type of food, meal times etc. These conditions form integral part of each package or offering. As such, it is in the responsibility of the customer to comply with these basic requirements, acknowledge the package conditions and limitations.

Liabilities Restaurants.mu offers a range of services, a restaurant directory, reviews, content and products while also acting as a booking agent for the relevant service providers for discounted meal packages and/or any other services. We have no liability of any kind whatsoever to you or your group, or dependents for any death, personal injury, loss, consequential loss or damage of any kind you or your group, or your dependents may suffer unless caused by our own negligence.

Restaurants.mu, Directors, Employees, service providers and partners, in no event are liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the site, the content, statements and other information contained therein, the products or services accessible or available through the site or these terms of use. However, the Service Provider/third party will be solely responsible for providing the product/service with due care, making sure that the service provided is of the highest quality and of high service standards.

By using Restaurants.mu, you agree to indemnify us and its employees against any liability, although we may at our discretion agree to assist in the resolution of problems, and take our own action against any supplier and third party who is in breach of its obligations.

Customer?s behavior As a customer of Restaurants.mu, you are responsible for you and your party?s/group actions whereby you are expected to respect your environment and other people around you.

All service providers have every right to terminate, your booking or refuse to offer their services under threat of vandalism, violence or any other behavior seen as inappropriate by them. You must not behave in a way which may cause distress or annoyance to others or which may create the risk of danger or damage to any property. In any of these cases mentioned hereof, all insurances will be invalidated and you will not have any entitlement to a refund, compensation or to cover any of your expenses of any kind whatsoever. In case of damages or loss caused by you or any member of your group, you will be held responsible and be liable for full payment for these damages.

Litigation Any claim or dispute will always be dealt with the best attention and care, as the person that takes the pains of submitting his claim is presumed to do so in good faith. In case of litigation, the client will at first deal with the company for an amicable solution of the problem. If a solution cannot be found, the Mauritian legal system will be the sole competent legal system.

Applicable Laws This Agreement or Terms and Conditions is constructed in accordance with and governed by the laws of Mauritius. Any litigation related to the commercial relationship existing between Restaurants.mu and the client are submitted to the sole competence of the Mauritian jurisdictions.

Restaurants.mu Newsletters At various points throughout the Restaurants.mu website, you may choose to sign up for a subscription to the Restaurants.mu Newsletter. In order to sign up to receive the newsletters from Restaurants.mu, you will be asked to provide your e-mail address. If you have signed up for our email newsletter and subsequently wish to unsubscribe, we will promptly honor your request. To stop receiving our email newsletter, simply send us email requesting to be removed from our email or mail list. You may also go to our Contact Us page, fill in the contact form and send us a request to unsubscribe you from our email or mailing list. All unsubscribe requests are promptly processed.
